Welcome to Portfolio.Website, a service provided by Code Axiom ("we," "our," or "us"). By accessing or using our portfolio website builder platform, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our service.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the service after any changes constitutes acceptance of the new Terms.

2. Description of Service

Portfolio.Website is a portfolio-as-a-service platform that allows users to:

• Create and host professional portfolio websites
• Choose from professional templates designed for various industries
• Customize content and themes using our visual editor
• Receive a professional subdomain (yourname.portfolio.website)
• Access analytics, contact form management, and other features
• Connect custom domains (optional)

3. Account Registration

3.1 Eligibility

You must be at least 16 years old to use our service. By registering, you represent that you meet this requirement and have the legal capacity to enter into these Terms.

3.2 Account Information

You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account access.

3.3 One Portfolio Per User

Each user is entitled to one portfolio. This encourages quality over quantity and ensures you can focus on creating your best professional presence.

4. Free Trial and Subscription

4.1 Free Trial

We offer a 7-day free trial with full access to all features. No credit card is required to start your trial. During the trial, your portfolio will be publicly accessible.

4.2 Subscription Pricing

After your trial ends, you may continue using our service by subscribing:

• Monthly Plan: $5/month, billed monthly
• Annual Plan: $39/year, billed annually (35% savings)

All prices are in USD. We reserve the right to change pricing with reasonable notice.

4.3 Trial Expiration

If you do not subscribe before your trial ends, your portfolio will be automatically unpublished. You will receive email notifications before and after trial expiration. No charges will be made unless you actively subscribe.

4.4 Billing and Payment

Payments are processed securely through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis. You are responsible for keeping your payment information current.

4.5 Cancellation

You may cancel your subscription at any time from your dashboard. Upon cancellation:

• Your subscription will remain active until the end of your current billing period.
• After the billing period ends, your portfolio will be unpublished.
• No refunds are provided for partial billing periods.

4.6 Refund Policy

Due to the 7-day free trial, we generally do not offer refunds. The trial period allows you to fully evaluate our service before committing to a paid subscription. In exceptional circumstances, refund requests may be considered at our discretion.

5. User Content

5.1 Ownership

You retain ownership of all content you create and upload to your portfolio, including text, images, and other materials ("User Content"). By using our service, you grant us a non-exclusive, worldwide, royalty-free license to host, display, and distribute your User Content solely for the purpose of providing our service.

5.2 Content Responsibility

You are solely responsible for your User Content. You represent and warrant that:

• You own or have the necessary rights to use and share all content on your portfolio.
• Your content does not infringe on any third party's intellectual property rights.
• Your content is accurate and not misleading.

5.3 Prohibited Content

You agree not to post content that:

• Is illegal, harmful, threatening, abusive, or harassing
• Contains sexually explicit material, hate speech, or discrimination
• Infringes on intellectual property rights
• Contains malware, viruses, or malicious code
• Is spam or deceptive in nature
• Violates any applicable laws or regulations
• Impersonates another person or entity

5.4 Content Moderation

We reserve the right to review, remove, or disable access to any content that violates these Terms or is otherwise objectionable, at our sole discretion and without prior notice.

6. Subdomains and Custom Domains

6.1 Subdomain Allocation

You may select an available subdomain (e.g., yourname.portfolio.website) for your portfolio. Subdomain allocation is on a first-come, first-served basis.

6.2 Subdomain Restrictions

We reserve the right to refuse, reclaim, or reassign subdomains that:

• Infringe on trademarks or brand names
• Are offensive, misleading, or inappropriate
• Are associated with terminated accounts
• Violate our policies

6.3 Custom Domains

You may connect your own custom domain to your portfolio. You are responsible for domain registration, DNS configuration, and any associated costs with your domain registrar.

7. Intellectual Property

7.1 Our Intellectual Property

Portfolio.Website, including our templates, design, code, logos, and other materials, are owned by Code Axiom and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from our materials without our express written permission.

7.2 Template License

Your subscription grants you a limited, non-exclusive, non-transferable license to use our templates for your portfolio while your subscription is active. This license does not include the right to resell, redistribute, or use templates for purposes other than your personal portfolio.

8. Service Availability

We strive to maintain 99.9% uptime for our service. However, we do not guarantee uninterrupted access and are not liable for any downtime, whether scheduled or unscheduled. We may modify, suspend, or discontinue any aspect of the service at any time.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PORTFOLIO.WEBSITE AND CODE AXIOM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF OUR SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the service will be error-free, uninterrupted, or secure, or that any defects will be corrected.

11. Indemnification

You agree to indemnify, defend, and hold harmless Code Axiom and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the service
• Your User Content
• Your violation of these Terms
• Your violation of any third-party rights

12. Termination

We may suspend or terminate your account and access to the service at any time, with or without cause, with or without notice. Reasons for termination may include:

• Violation of these Terms
• Fraudulent or illegal activity
• Non-payment of subscription fees
• At your request

Upon termination, your portfolio will be unpublished. We may retain certain data as required by law or for legitimate business purposes.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in Travis County, Texas.

14. Dispute Resolution

Before filing any formal legal claim, you agree to contact us first to attempt to resolve the dispute informally. Most concerns can be resolved quickly and to your satisfaction by emailing support@portfolio.website.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Code Axiom regarding your use of Portfolio.Website and supersede any prior agreements.
